Warunki aukcji - Tyszko & Cichoń Equestrian

OGÓLNE 1. Organizatorem aukcji jest TC Equestrian sp. sp. z o.o., ul. Anieli Krzywoń 1, 41-922 Radzionków, KRS 0000877958. Konie umieszczone w katalogu sprzedawane są przez Organizatora, działającego w imieniu i na rzecz właścicieli koni.

2. Pochodzenie koni umieszczone w katalogu jest oparte na przedstawionych przez właściciela konia, a zweryfikowanych przez Organizatora, dokumentach pochodzenia.

3. Płeć, data urodzenia i opis konia umieszczone są w katalogu, przy czym opis nie stanowi prawnej gwarancji posiadania przez konia określonych cech i nie może stanowić podstawy ewentualnych roszczeń.

STAN ZDROWIA: 4. Oferowane konie zostały w dniu 13.12.20 r. przebadane klinicznie i radiologicznie, na okoliczność czego sporządzony został protokół weterynaryjny oraz komplet zdjęć RTG, które dostępne są na platformie aukcyjnej.

5. Deklaracja stanu zdrowia koni ze strony Organizatora ograniczona jest do treści ujętych w protokole badania weterynaryjnego. Organizator nie składa zapewnień co do żadnych innych okoliczności związanych ze stanem zdrowia, potencjalnymi możliwościami czy charakterystyką koni.

6. W przypadku zakupu konia i powiadomieniu Organizatora o zamiarze jego odbioru, Sprzedający będzie zobowiązany do przeprowadzenia ponownego badania klinicznego konia, najwcześniej na 2 dni przed planowanym odbiorem, a najpóźniej w chwili odbioru konia, na okoliczność którego sporządzony zostanie weterynaryjny „Protokół odbioru konia”, który zostanie okazany Kupującemu w momencie odbioru konia.

7. W przypadku gdyby stan konia w momencie odbioru, lub treść okazanego Kupującemu protokołu budziła zastrzeżenia Kupującego, zobowiązany jest on, pod rygorem utraty uprawnień z tytułu rękojmi za wady, do zaniechania odbioru konia i natychmiastowego powiadomienia o tym fakcie Organizatora.

PRZEKAZANIE KONIA I PRZEJŚCIE RYZYKA: 8. Odpowiedzialność za konia przechodzi na Kupującego w momencie zakończenia licytacji na platformie internetowej, co stanowi substytut przejścia posiadania zwierzęcia. Własność konia przechodzi na Kupującego dopiero w momencie zapłaty całości ceny.

9. Koń musi zostać odebrany od Sprzedającego najpóźniej w terminie 2 tygodni od zakończenia aukcji, a Kupujący zobowiązany jest powiadomić Organizatora o planowanym terminie odbioru.

10. Odbiór odbywa się na koszt Kupującego.

LICYTACJA I ZAPŁATA: 11. Aukcja zostanie przeprowadzona w walucie EUR.

12. Oferta, aby została przyjęta, musi wynosić minimum 500,00 EUR.

14. Celem otrzymania możliwości telefonicznego udziału w licytacji, koniecznym jest dokonanie rejestracji min. na 2h przed zakończeniem aukcji.

15. Nabywcą konia staje się osoba oferująca najwyższą cenę, o ile zostanie osiągnięta cena minimalna zastrzeżona przez sprzedającego. Wszelkie spory, jakie mogą zaistnieć w czasie licytacji, będą rozstrzygane przez Organizatora, który ma również prawa wycofania każdego konia z licytacji bez podania przyczyny.

16. Dokonanie postąpienia licytacyjnego na platformie online równoznaczne jest z akceptacją niniejszych warunków.

17. Cena osiągnięta w trakcie licytacji stanowi cenę netto, do której doliczony zostanie podatek VAT, w wysokości zależnej od statusu podatkowego Sprzedającego. Lista stawek VAT dla poszczególnych konni będzie udostępniona w dniu aukcji.

18. Niezależnie od powyższego do ceny osiągniętej w trakcie licytacji Organizator doliczy 7% prowizji + VAT.

19. Organizator jest upoważniony do przyjmowania zapłaty za wylicytowane konie – płatność odbywa się na podstawie wystawionej w terminie 2 dni od zakończenia aukcji Faktury VAT.

20. Koń nie może zostać wydany Kupującemu do czasu zaksięgowania całości należności na koncie Organizatora.

21. Prawo rozstrzygania wszystkich sporów powstałych poza licytacją, a związanych z przebiegiem aukcji, należy do Organizatora.

22. Dla aukcji właściwe jest prawo polskie, a dla rozstrzygania ewentualnych sporów sąd właściwy dla siedziby Organizatora.

GENERAL 1. The Organizer of the Auction is TC Equestrian Ltd., ul. Anieli Krzywoń 1, 41-922 Radzionków, KRS 0000877958. The horses included in the catalogue are sold by the Organizer acting on behalf of the owners of the horses.

2. The origin of horses included in the catalogue is based on presented by the Owner and veriified by the Organizer documents of the oriigin.

3. Sex, date of birth and the description of the horse are included in the catalogue and the description does not constitute the legal guatantee of the virtues possessed by the horse and can not be the subject of any claims.

HEALTH CONDITIONS: 4. The offered horses were radilologically and clinically examindd on the 13th of December 2020 with the veterinary protocol and RTG scans available on the Auction website platform.

5. The declaration of the heslth conditiins on behalf of the Organizer is limited to the content included in the protocol of the veterinary check. The Organizer does not make any other assurance concerning the terms connected with the health conditions of the horse, its potential or characteristics.

6. In case of the purchase and informing the Organizer of the intended collection of the horse, the Seller is obliged to conduct another clinical vet check of the horse within 2 days prior to the collection and the latest at the moment of collection with the veterinary protocol prepared called „The Protocol of the Collection of the horse" which will be presented to the Buyer at the moment of the collection of the horse.

7. In case the health condition of the horse at the moment of collection or the content of the veterinary protocol presented to the Buyer is subject to Buyer’s objections he is obliged under pain of losing the entitlement due to the flaws to abandon the collection of the horse and to inform the Organizer about that fact.

THE COLLECTION OF THE HORSE AND THE RISK TRANSFER: 8. The responsibility for the horse is transferred on the Buyer at the moment the bidding on the website platform is completed which is the substitute of the transfer of the animal’s ownership. The factual ownership of the horse is transferred on the Buyer at the moment of submitting the full payment for the horse.

9. The horse has to be collected by the Buyer latest two weeks after the bidding is finished and the Buyer is obliged to inform the Organizer about the planned collection of the horse.

10. The cost of the horse’s collection is on the Buyer’s side.

BIDDING AND PAYMENT: 11. The Auction is conducted in EUR.

12. The offer to be accepted has to be of the minimum 500,00 EUR.

14. In order to be able to bid through telephone call it is necessary to register at least two hours before the end of the Auction.

15. The Buyer of the horse becomes the person offering the highest price under condition the minimum price restricted by the Seller is achieved. All arguments which may occur during the bidding will be resolved by the Organizer who also has the right to withdraw any horse form the bidding without stating his reasons.

16. Taking part in the bidding is equal with the acceptance of above terms and conditions.

17. The price reached through the bidding is the netto value to which VAT tax will be added in the amount dependent on the tax status of the Seller. The list of VAT rates for each horse will be available on the date of the Auction.

18. Independently of above the Organizer will add 7% provision + VAT to the price reached through the bidding.

19. The Organizer is authorized to accept the payment for the auctioned horses - the payment takes place on the basis of VAT invoice issue within 2 days from the termination of the Auction.

20. The horse cannot be given to the Buyer is the whole payment is accounted for.

21. The Organizer has the right to sort out all the arguments arisen outside the bidding and connected with the course of the Auction.

22. The binding law of the Auction is Polish Law and any arguments will be sorted out by the court competent for the Organizer’s location.
